Who Can File?

Either parent may file a Paternity Complaint.

When is it appropriate to file a Paternity Complaint?

Paternity Complaints are filed by either the Mother or the possible Father when it is necessary to determine the actual biological Father via a DNA Test. When the DNA of the Mother, Child and possible Father are compared the test results are more than 99% accurate.

Paternity Complaints are also filed when there is no question of who the biological father is, however, the parents were not married at the time the child was born and there is a desire by at least one of the parents for a Court order establishing custody, visitation and child support.

If I know that I am the Father, can I get visitation pending the final outcome of the case?

These guidelines are exactly that... guidelines, and the judge may deviate from them if he believes that doing so is in the best interest of the children.

Who has to pay for the DNA test?

That is determined by the Court. Keep in mind that if you deny that you are the biological Father but the test indicates that you are then you may be ordered to pay 100% of the cost of the test which is usually approximately $400. Likewise if the test indicates that you are not the biological father then the Mother may be ordered to pay 100% of the costs.
